ASSUMPTION OF RISK, HOLD HARMLESS, INDEMNIFICATION, AND RELEASE AGREEMENT
1. In
consideration of the use of the premises of the Flintridge Riding Club, the
undersigned recognizes and agrees that participation in horse sports and
horse-related activities is DANGEROUS AND HAZARDOUS, AND MAY EVEN LEAD TO
PERMANENT INJURY OR DEATH.
2. Recognizing
and agreeing to the same, the undersigned knowingly and expressly ASSUMES ANY
AND ALL RISK of any loss, damage or bodily injury and AGREES TO HOLD HARMLESS,
REGARDLESS OF NEGLIGENT ACTS OR OMISSIONS, the Flintridge Riding Club, its
directors members, agents, and employees, and any instructor, or contractor, of
the Flintridge Riding Club, and his or her employees or employee thereof,
(collectively, "Club").
3. The
undersigned shall be responsible for any loss, damage or bodily injury that may
be assigned to any person by any horse rider or under the control of the
undersigned while on the premises of the Flintridge Riding Club, or in the
environs thereof, while riding or controlling a horse, and shall INDEMNIFY the
club against all claims or demands of any nature that may grow out of any such
loss, damage, or bodily injury.
4. In
addition to the above ASSUMPTION OF RISK, HOLD HARMLESS, and INDEMNIFICATION,
the undersigned knowingly and expressly RELEASES the Club of ANY ACTS OF
NEGLIGENCE, WHETHER ACTIVE OR PASSIVE.
5. This
ASSUMPTION OF RISK, HOLD HARMLESS, INDEMNIFICATION, AND RELEASE AGREEMENT
("AGREEMENT") is made on behalf of the undersigned, and any guest or
relative of the undersigned, including minor children or wards thereof.
This AGREEMENT shall include the payment of any attorneys' fees, and
shall include the reimbursement to the Club arising out of any loss, damage, or
injury to the property of the undersigned, including any guest, relative, minor
children, or wards thereof, from any cause whatsoever, INCLUDING PASSIVE OR
ACTIVE ACTS OF NEGLIGENCE of the Club.
6. THE
UNDERSIGNED RECOGNIZES AND AGREES THAT BY EXECUTING THIS ASSUMPTION OF RISK,
RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT, HE OR SHE IS WAIVING AND
RELEASING VALUABLE LEGAL RIGHTS.
STABLE POLICY
The Stable Manager has authority,
in consultation with the Board of Directors, to determine issues of safety and
prudent management for horses, members, and personnel.
While a member's location preference will be considered, individual
stalls and corrals are not the property of the members, but may be reassigned
when necessitated by a horse's behavior or health needs.
Grooming services may be denied a particularly fractious horse, and the
owner may be asked to perform grooming him or herself.
In extreme cases of equine misbehavior, the horse shall be relocated off
Club property. The number of stalls
that can be made available for use by stallions may be limited.
Members cannot assume that they can bring in any horse without
confirmation by the Stable Manager that a suitable stabling location is
available. There will be no
teasing, breeding, or semen collection on Club grounds.
Only FRC contracted instructors shall be given the privilege of training
on FRC grounds.
